These Website Terms of Use (Website Terms) apply when you access or use www.laxiong.com.au (Website). The Website is operated by La Xiong, trading as LAXIONG (ABN 21 233 912 718) (LAXIONG, we, us or our).
By accessing or using the Website, you agree to these Website Terms. If you do not agree, you must not use the Website.
Purchases made through the Website are also governed by our Terms and Conditions at https://www.laxiong.com.au/policies/terms-of-service. Our Privacy Policy at https://www.laxiong.com.au/policies/privacy-policy explains how we handle personal information. If these Website Terms conflict with the Terms and Conditions in relation to a purchase, the Terms and Conditions apply to that purchase.
We may update these Website Terms by publishing a revised version. Changes apply from the stated effective date and do not retrospectively alter an order already accepted unless required by law or agreed with you.
2. Access and permitted use
You may use the Website for lawful personal or business purposes connected with learning about LAXIONG, browsing products, communicating with us and placing or managing orders.
You must comply with applicable laws and must not use the Website in a way that infringes another person's rights, interferes with the Website or exposes us or another person to harm.
3. Prohibited conduct
You must not, except where permitted by law or with our prior written consent:
This clause does not prohibit ordinary search-engine indexing, accessibility technology, browser functions or other legitimate use that we have authorised or that cannot lawfully be restricted.
4. Accounts and security
If you create an account, you must provide accurate information and keep your login details secure. Notify us promptly if you suspect unauthorised access or use. You are responsible for activity carried out through your account to the extent it resulted from your failure to take reasonable security precautions.
We may suspend or restrict access where reasonably necessary to protect you, other users, us or the Website, investigate suspected misuse, or comply with law. Where practicable, we will explain the reason and provide a reasonable opportunity to address the issue.
5. Website information
We take reasonable care to keep Website information accurate and current. However, images, colours, measurements, availability, descriptions and other information may occasionally contain errors or may change. Product images are illustrative and colours can display differently across devices and lighting conditions.
Information on the Website is general information and is not professional advice. Size guides and measuring instructions are intended to assist you but do not replace careful measurement or advice tailored to your circumstances.
If we identify an error affecting an order, we will deal with it under our Terms and Conditions and applicable law. Nothing in this clause permits us to supply goods that do not meet applicable consumer guarantees.
6. Availability and changes
We do not guarantee that the Website will always be available, uninterrupted, secure or error-free. We may maintain, update, suspend or change parts of the Website. We will not use this clause to avoid obligations relating to an accepted order or rights that cannot lawfully be excluded.
7. Intellectual property
The Website and its content, including garment designs, text, graphics, logos, photographs, videos, layouts, downloads and software (Website Content), are owned by or licensed to LAXIONG and are protected by intellectual property laws.
We grant you a limited, non-exclusive, revocable permission to access and view Website Content for lawful personal shopping and informational purposes. No ownership rights are transferred to you.
You must not reproduce, manufacture from, distribute, sell, adapt, publish or commercially exploit Website Content without our prior written consent, except as permitted by law. LAXIONG names, logos and branding must not be used in a way that suggests sponsorship, affiliation or endorsement without permission.
8. Third-party services and links
The Website is powered by Shopify and may use third-party payment, analytics, communication, social-media and delivery services. It may also link to third-party websites. Those services and websites may have their own terms and privacy policies.
We do not control independent third-party content or services and are not responsible for them merely because a link is provided. However, using a third party does not exclude any responsibility we have under applicable law.
9. Privacy
We handle personal information in accordance with our Privacy Policy at https://www.laxiong.com.au/policies/privacy-policy. Please review it before providing personal information through the Website.
10. Reporting problems
If you identify suspected misuse, a security issue, an error in Website Content or difficulty accessing the Website, please contact us at laxiong58@gmail.com. Do not conduct security testing without prior written authorisation.
11. Liability
Nothing in these Website Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded or limited, including under the Australian Consumer Law.
To the extent permitted by law, we are not liable for loss caused by your unlawful or unauthorised use of the Website, your failure to maintain reasonable account or device security, independent third-party content, or events outside our reasonable control, except to the extent the loss was caused or contributed to by our breach, negligence or failure to comply with a non-excludable obligation.
To the extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable. Any limitation applies only to the extent it is fair, reasonable and lawful in the circumstances.
12. Governing law
These Website Terms are governed by the laws of Queensland, Australia. You and LAXIONG submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them. This does not prevent a person from exercising a right available in another jurisdiction where that right applies and cannot lawfully be excluded.
13. General
If any provision is invalid or unenforceable, it will be read down to the minimum extent necessary or severed, and the remaining provisions will continue to operate.
A failure or delay in exercising a right is not a waiver of that right. Headings are for convenience only and do not affect interpretation. The words 'including' and 'includes' are not words of limitation.
