These Terms and Conditions govern your use of www.laxiong.com.au (Website) and your purchase of made-to-order or custom-sized garments and related products from La Xiong, trading as LAXIONG (LAXIONG, we, us or our). By using the Website or placing an order, you agree to these Terms and Conditions.

Please read these terms before placing an order. If you do not agree with them, do not use the Website or purchase a product. Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

1. About LAXIONG

LAXIONG is an Australian clothing brand offering garments made to order and/or produced using measurements selected or supplied by the customer. Our Website is www.laxiong.com.au. You can contact us at designerlx196@gmail.com

2. Eligibility and customer information

You must have legal capacity to enter into a binding contract. If you are under 18, you may place an order only with the involvement and permission of a parent or legal guardian.

You must provide complete, current and accurate order, contact, measurement, billing and delivery information. You must be authorised to use the payment method submitted with your order.

 


When you submit an order, you offer to purchase the products shown in your order for the total price displayed at checkout. An automated acknowledgement does not necessarily mean we have accepted the order.

A binding contract is formed when we accept your order and send an order confirmation. We may refuse or cancel an order before production begins if, for example, a product or material is unavailable, there is an obvious pricing or description error, payment is not authorised, we reasonably suspect fraud, or we cannot fulfil the requested design or measurements. If we cancel an order after receiving payment, we will refund the amount paid for the cancelled item to the original payment method.

Please check your order confirmation promptly and contact us immediately if any information is incorrect.

4. Made-to-order and custom-sized products

4.1 Measurements

You may be asked to provide or select measurements including height, bust, waist, hips, garment length or other measurements needed to make your garment (Measurements). You are responsible for following our measuring instructions and checking that the Measurements supplied are accurate.

If you discover an error, contact us immediately. We will try to accommodate a correction, but we cannot guarantee that an order can be changed after pattern preparation, fabric cutting or production has begun.

A correctly produced custom-sized garment is not faulty merely because it does not fit when the Measurements supplied by the customer were inaccurate. This does not limit your rights if we fail to make the garment substantially in accordance with the confirmed Measurements or if the garment otherwise fails to meet a consumer guarantee.

4.2 Fit and measuring guidance

Our size guides, height recommendations and measuring instructions are intended to help you select a size or provide Measurements. Fit can vary according to body shape, posture, preferred ease, footwear and styling. If you are unsure, contact us before ordering.

4.3 Reasonable handmade variation

Because garments are made individually, minor differences may occur in lace or print placement, pattern alignment, hand-finished details and finished measurements. Colours may also appear different across screens, lighting conditions and dye lots. These variations do not permit us to supply a product that is materially different from its description, approved design, sample or confirmed order.

5. Production times and delays

Estimated production and dispatch times are stated on the relevant product page or communicated to you before or after ordering. Unless we expressly confirm a guaranteed date in writing, all production and delivery dates are estimates.

Production may be affected by fabric availability, supplier delays, the complexity of the garment, measurement queries, public holidays or events outside our reasonable control. If a significant delay occurs, we will notify you and provide an updated estimate.

If we cannot supply your order within a reasonable time, we will provide an appropriate solution as required by Australian Consumer Law. Please contact us before ordering if the garment is required for a particular event. We do not guarantee arrival by an event date unless we expressly agree to that date in writing.

6. Prices, GST and payment

All prices are displayed in Australian dollars. Prices include GST where GST is applicable. Delivery charges, duties or other charges will be shown or described before you complete your order where reasonably practicable.

Payment is required at checkout unless another arrangement is expressly stated. Payments may be processed by third-party providers made available through Shopify. Your use of those payment methods may also be subject to the provider's terms and privacy policy.

Any card surcharge we apply will not exceed our permitted cost of accepting that payment method. If there is no reasonably available surcharge-free payment option, the minimum unavoidable surcharge will be included in the displayed price as required by law.

If we identify an obvious pricing, shipping or description error before production begins, we will contact you. You may confirm the order at the corrected price or cancel it for a full refund. We will not change the agreed price after accepting the order except with your agreement or where required by law.

7. Promotional codes

Promotional codes must be entered at checkout and cannot be applied retrospectively unless we agree otherwise. Codes cannot be redeemed for cash and may be subject to an expiry date, minimum spend, product exclusions or other disclosed conditions. We may cancel or refuse a code that is expired, used contrary to its conditions or affected by an obvious error or suspected misuse.

8. Changes and cancellations

Our garments are made specifically for each order. You may request a change or cancellation by contacting us as soon as possible, but approval is not guaranteed.

Once pattern preparation, fabric cutting, sourcing specifically for your order or production has begun, the order cannot be cancelled or changed for change-of-mind reasons. Before that point, we may agree to a cancellation or change and may deduct reasonable costs already incurred, provided those costs are disclosed to you.

This clause does not limit any cancellation or refund right available under Australian Consumer Law, including where we cannot supply the product within a reasonable time or the product fails to meet a consumer guarantee.

9. Shipping and delivery

Shipping charges and available delivery services are displayed at checkout or otherwise communicated before the order is completed. Delivery estimates begin after production is complete and the order has been dispatched.

You are responsible for providing a complete and correct delivery address. Contact us immediately if it is incorrect. If the order has not been dispatched, we will make reasonable efforts to update it. If an order is returned or requires redelivery because of an incorrect address supplied by you, an uncollected parcel or another matter within your control, we may charge the reasonable redelivery cost.

We remain responsible for addressing delivery problems in accordance with applicable law. If an order is lost, damaged in transit or not delivered within a reasonable time, contact us so we can investigate with the carrier and provide an appropriate solution. We may ask you to assist with reasonable enquiries, photographs, declarations or carrier processes.

Risk in a product passes to you when it is delivered to you or a person authorised by you. Ownership passes when we have received full payment.

10. International orders

We may accept or decline international orders. International orders may attract import duties, customs charges, taxes or clearance fees imposed by the destination country. Unless checkout expressly states otherwise, the customer is responsible for these charges.

Customs processing may delay delivery. We are not responsible for delays caused solely by customs authorities, but we will provide reasonable assistance with shipping information. If an international shipment is returned because duties were not paid or delivery was refused, we may deduct reasonable return and redelivery costs from any amount otherwise refundable, to the extent permitted by law.

11. Returns, exchanges and consumer guarantees

11.1 Change of mind

Because every garment is made to order or custom-sized, we do not accept returns, exchanges or refunds for change of mind, including where you no longer want the garment, ordered the wrong design or supplied inaccurate Measurements.

11.2 Your rights under Australian Consumer Law

Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Products must, among other things, be of acceptable quality, match their description and be fit for any disclosed purpose that we agreed to meet.

If a product has a major problem, you may be entitled to choose a refund or replacement. If a problem is minor, we may choose to repair the product within a reasonable time. If we cannot repair a minor problem within a reasonable time, you may be entitled to another remedy. You may also have rights to compensation for reasonably foreseeable loss or damage caused by a failure to meet a consumer guarantee.

11.3 Reporting a problem

Contact designerlx196@gmail.com as soon as reasonably practicable with your order number, a description of the issue and clear photographs where helpful. We may request proof of purchase and ask you to return the garment for assessment.

For a garment that can be posted or easily returned, you may initially be asked to arrange return postage. If the product is confirmed to have a problem covered by Australian Consumer Law, we will reimburse reasonable return postage costs. We may provide a prepaid return method where appropriate.

A product will not be considered faulty where the issue results from fair wear and tear, accidental damage, misuse, failure to follow reasonable care instructions, unauthorised alteration, or inaccurate Measurements supplied by the customer. However, we will assess each claim fairly and will not deny any right that cannot lawfully be excluded.

12. Care, alterations and customer-supplied materials

You must follow the care instructions supplied with the garment. Alterations performed by another person after delivery may affect our ability to determine the cause of a reported issue, but do not automatically remove rights that otherwise apply under law.

If we agree to use fabric, trims or other materials supplied by you, responsibility for defects inherent in those materials will be discussed and agreed before production. We remain responsible for the quality of our workmanship.

13. Reviews and customer content

If you submit a review, photograph, video or other content to us, you confirm that it is accurate, lawful, not misleading, and that you have permission from any identifiable person shown in it.

Submitting content through a feature that clearly states it may be published gives us a non-exclusive, royalty-free permission to display that content on our Website and brand social-media channels in connection with the review. We will seek separate permission before using customer content in paid advertising or materially altering it. You may ask us to stop using your content prospectively, subject to reasonable time to action the request and any lawful record-keeping obligations.

14. Intellectual property

The Website, garment designs, photographs, graphics, text, logos, labels, packaging and other content are owned by or licensed to LAXIONG and are protected by intellectual property laws.

You may access the Website for personal shopping and informational purposes. You must not reproduce, manufacture, sell, commercially exploit, scrape, republish or adapt our designs or Website content without our prior written permission, except as permitted by law.

15. Acceptable use and Website security

You must not use the Website unlawfully, fraudulently or in a way that interferes with its operation or security. You must not attempt to gain unauthorised access, introduce malicious code, overload the Website, circumvent security controls, or use automated tools to extract data except with our written permission or as permitted by law.

If you create an account, you are responsible for keeping your login details secure and for notifying us promptly of suspected unauthorised access. We may suspend an account where reasonably necessary to protect the customer, other users, us or the Website.

16. Website information and availability

We take reasonable care to ensure that product descriptions, measurements, prices and other Website information are accurate. Images are illustrative and colours may display differently across devices. If we discover a material error affecting an order, we will contact you promptly and provide an appropriate solution.

We do not guarantee uninterrupted access to the Website. We may maintain, update, suspend or modify Website functionality from time to time. These provisions do not limit liability for an accepted order or any right that cannot be excluded by law.

17. Third-party services and links

The Website is hosted using Shopify and may use third-party payment, analytics, communication and delivery services. Third-party websites and services may have their own terms and privacy policies. We are not responsible for independent third-party content or services, but using a third party does not exclude any responsibility we have to you under applicable law.

18. Privacy

We collect and handle personal information, including contact, delivery and Measurement information, in accordance with our Privacy Policy available at https://www.laxiong.com.au/policies/privacy-policy.

Where necessary to fulfil an order, relevant information may be shared with service providers such as Shopify, payment providers, couriers, pattern makers or manufacturers. Our Privacy Policy explains how information is collected, used, disclosed, stored and accessed, including any overseas disclosures that apply.

19. Liability

Nothing in these terms excludes, restricts or modifies the Australian Consumer Law or any other right, guarantee, condition, warranty or remedy that cannot lawfully be excluded or limited.

To the extent permitted by law, we are not liable for loss caused by your inaccurate Measurements, incorrect delivery information, misuse, failure to follow care instructions, unauthorised alterations, or events outside our reasonable control, except to the extent the loss was caused or contributed to by our breach, negligence or failure to comply with a non-excludable obligation.

To the extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable. Any limitation in this clause applies only to the extent it is fair, reasonable and lawful in the circumstances.

20. Events outside reasonable control

A party is not responsible for delay or failure to perform an obligation, other than an obligation to pay money, to the extent caused by an event outside that party's reasonable control. Such events may include natural disasters, fire, flood, war, civil disturbance, public-health emergencies, government action, industrial disruption, transport interruption or widespread telecommunications failure.

The affected party must take reasonable steps to reduce the impact and resume performance. If the event prevents us from supplying an order within a reasonable time, we will provide a solution consistent with Australian Consumer Law.

21. Changes to these terms

We may update these terms by publishing a revised version on the Website. The terms accepted when an order is placed will continue to govern that order, unless a change is required by law or you agree otherwise. The date at the beginning of the document shows when it was last updated.

22. Notices and contact

You may contact us at designerlx196@gmail.com. We may contact you using the email address, telephone number or delivery details associated with your order. You are responsible for keeping those details current and checking communications relating to your order.

23. Governing law

These terms are governed by the laws of Queensland, Australia. You and LAXIONG submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them. This clause does not prevent a consumer from exercising rights available in another jurisdiction where those rights apply and cannot lawfully be excluded.

24. General provisions

If any provision is invalid or unenforceable, it will be read down to the minimum extent necessary or severed, and the remaining provisions will continue to operate.

A failure or delay in exercising a right is not a waiver of that right. You may not assign your rights or obligations under an order without our written consent, except where the law permits otherwise. We may transfer our rights and obligations as part of a genuine sale, restructure or transfer of the business, provided this does not reduce your rights.

These terms, the relevant product page, your confirmed Measurements, the order confirmation and any written variation agreed between us form the agreement for your order. If there is an inconsistency, a specific written agreement about your order takes priority to the extent of that inconsistency, subject always to applicable law.
