This Privacy Policy explains how La Xiong, trading as LAXIONG (LAXIONG, we, us or our), collects, holds, uses and discloses personal information through www.laxiong.com.au (Website), our Shopify store, communications and made-to-order garment services.

We are committed to handling personal information responsibly. Where the Privacy Act 1988 (Cth) and the Australian Privacy Principles apply to us, we will comply with them. We also use this Policy as our privacy standard where those laws do not strictly apply.

1. Information we collect

The types of personal information we collect depend on how you interact with us. They may include:

identity and contact details, such as your name, email address, telephone number, billing address and delivery address;
order and account information, including products selected, order history, customer-service communications and account login details;
made-to-order information, including height, bust, waist, hips, garment length and other measurements or fit preferences needed to prepare a pattern or make a garment;
transaction information, such as payment status, payment method, refunds and fraud-screening results. Full card details are generally processed by Shopify or another payment provider rather than stored by us;
marketing preferences, competition or promotion entries, reviews, photographs, videos and social-media interactions; and
technical and usage information, such as IP address, browser and device information, cookie identifiers, approximate location, pages viewed, referral source and interactions with our Website or advertising.

If you provide personal information about another person, you must have their permission to do so and must make them aware of this Policy where appropriate.

2. Measurements and sensitive information

Body measurements supplied for garment construction are personal information. They are not automatically health information or sensitive information merely because they relate to the body.

You may voluntarily tell us about a health condition, disability, pregnancy, mobility requirement or other sensitive matter so that we can discuss fit or accessibility needs. We will collect that information only with your consent, where it is reasonably necessary for the requested service, and will use or disclose it only for that purpose or as otherwise permitted by law. Please do not provide medical details that are unnecessary for making your garment.

3. How we collect information

We usually collect personal information directly from you when you:

visit or use the Website, create an account or place an order;
submit measurements, complete a form, subscribe to marketing or enter a promotion;
contact us by email, telephone, social media or another channel;
submit a review, photograph, video or other content; or
interact with cookies, analytics tools, advertisements or social-media features.

We may also receive information from Shopify, payment providers, delivery partners, fraud-prevention providers, analytics and advertising providers, social-media platforms, or another person authorised to act for you.

4. Why we collect and use information

We may collect, hold and use personal information to:

process, confirm, make, alter, deliver, refund or otherwise administer your order;
prepare patterns and produce a garment using your selected or supplied measurements;
communicate about measurements, design approvals, materials, production, delivery and customer service;
operate accounts, process payments, detect fraud and protect the security of our Website and business;
manage returns, repairs, consumer-law claims, disputes and record-keeping obligations;
improve our Website, products, sizing guidance, customer experience and business operations;
send marketing where we have the required consent or another lawful basis, and manage opt-outs; and
comply with law, enforce our agreements and establish, exercise or defend legal claims.

If you do not provide information we reasonably need, we may be unable to make your garment, process your order, deliver it or respond to your request.

5. When we disclose information

We may disclose personal information only as reasonably necessary to:

Shopify and providers that host, secure or support our Website and customer accounts;
payment, fraud-prevention, accounting and refund providers;
couriers, postal services, fulfilment providers and customs authorities;
email, SMS, customer-support, analytics, advertising and social-media service providers;
professional advisers, insurers, regulators, law-enforcement bodies or courts where required or permitted by law; and
a purchaser or adviser involved in a genuine proposed sale, merger or restructure of our business, subject to appropriate confidentiality arrangements.

Customer measurements are received and managed by LAXIONG in Australia. We do not disclose customer measurements to overseas pattern makers, manufacturers or other overseas production partners. We do not sell personal information for money.

6. Overseas disclosures

We do not send customer measurements to any other overseas production partner. However, Shopify and other technology, payment, analytics, communication or advertising providers may process or store other personal information in countries in which they or their service providers operate.

Where the Australian Privacy Principles apply, we take reasonable steps before an overseas disclosure to ensure the recipient handles personal information consistently with applicable Australian privacy requirements, unless an exception applies. Overseas privacy laws may differ from Australian law.

7. Payments

Payments made through the Website are processed using payment services made available through Shopify or another provider. Those providers may collect and use your payment information under their own privacy policies. We generally receive transaction confirmation and limited payment details rather than your complete card number or security code.

8. Cookies, analytics and advertising

Our Website and service providers may use cookies, pixels, local storage and similar technologies to keep the Website functioning, remember preferences, understand Website use, measure performance, prevent fraud and support advertising.

You can manage some cookies through the consent tools displayed on the Website, where available, and through your browser or device settings. Blocking some cookies may affect Website functions. Third parties may also process information under their own privacy policies. Any separate Cookie Policy published on our Website forms part of this Policy.

9. Direct marketing

We may send email or SMS marketing only where permitted by law, including where you have consented. You can unsubscribe using the link or instructions in a marketing message or by emailingdesignerlx@gmail.com. We will action unsubscribe requests as required by law. Service messages about an existing order may still be sent because they are necessary to fulfil the order.

10. Security and data breaches

We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Measures may include access controls, passwords, secure service providers, staff or contractor confidentiality requirements and limiting information supplied to production partners.

No method of online transmission or storage is completely secure. If a data breach occurs, we will assess and respond to it and, where the Notifiable Data Breaches scheme applies, notify affected individuals and the Office of the Australian Information Commissioner when required.

11. Retention

We retain personal information only for as long as reasonably needed for the purposes described in this Policy, including making and supporting an order, meeting tax and business record obligations, resolving disputes, preventing fraud and enforcing agreements.

When personal information is no longer required and we are not legally required to retain it, we take reasonable steps to delete, destroy or de-identify it. Different categories of information may have different retention periods. You may ask us to delete measurements that are no longer needed, subject to legal and operational requirements.

12. Access and correction

You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Contact laxiong58@gmail.com and provide enough information for us to identify the relevant records. We may need to verify your identity.

We will respond within a reasonable period. In limited circumstances permitted by law, we may refuse access or correction, or may charge a reasonable access cost. If so, we will generally explain the reason and available complaint options.

13. Children

Our Website is not directed to children. A person under 18 should place an order only with the involvement and permission of a parent or legal guardian. If we learn that we collected a child's personal information without appropriate authorisation, we will take reasonable steps to delete it where required.

14. Complaints

If you have a privacy concern or complaint, email designerlx@gmail.com with your name, contact details and a description of the issue. We will acknowledge and investigate the complaint and aim to respond within a reasonable period, generally within 30 days.

If the Privacy Act applies to us and you are not satisfied with our response, you may be able to complain to the Office of the Australian Information Commissioner at www.oaic.gov.au. The OAIC may ask you to complain to us first.

15. Third-party links

The Website may link to third-party websites, platforms or services. We do not control their privacy practices. Review their privacy policies before providing personal information to them.

16. Changes to this Policy

We may update this Policy to reflect changes to our practices, providers or legal obligations. The updated version will be published on the Website and will show a new last-updated date. Material changes may also be communicated by another reasonable method.
